ACCEPTANCE OF TERMS

By accessing or using the Read Nardagani mobile application (the "App"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the App.

ACCOUNT REGISTRATION AND USE

To use certain features of the App, you must create an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.

SUBSCRIPTION TERMS

The App offers a monthly subscription service known as the Monthly App Subscription, priced at $9.99 USD per month. Subscriptions will automatically renew every month on the purchase date unless canceled. You may cancel your subscription at any time through your account settings or via the platform where you originally subscribed. By subscribing, you agree to the terms and conditions outlined in our Privacy Policy and Terms of Use.

As a subscriber, you will receive access to all premium features of the App, including full access to levels and lessons, books, the Nardagani Key, and tutor mode.

PAYMENT AND BILLING

Subscription payments are processed through the in-app purchase system of your device's platform, such as Apple's App Store or Google Play. You authorize us to charge the subscription fee to your account, and any applicable taxes, on a recurring monthly basis. All subscription payments are non-refundable except as required by law or as outlined in our Refund Policy.

REFUND POLICY

We do not provide refunds for any subscription charges except where required by law or in the event of a technical failure that prevents access to the App. If you believe there has been an error in billing, please contact us at info@Nardagani.com.

PRIVACY POLICY AND DATA COLLECTION

We respect your privacy. Our Privacy Policy, which governs the collection, use, and sharing of your information, is available for review at https://backend.nardagani.com/privacy. We collect the following data: your first name, last name, email address, password, and date of birth, which are used to enhance your experience and personalize content within the App.

PARENTAL CONSENT

If you are under the age of 18, you must obtain parental or guardian consent to use the App. Parents or guardians can review, manage, and delete their child's account at any time by contacting us at info@nardagani.com.

USE LICENSE

If you access the App via a mobile application, we grant you a non-exclusive, non-transferable license to install and use the App on wireless devices you own or control. You may not decompile, reverse-engineer, or modify the App. The App may not be used for commercial purposes unless explicitly allowed by these Terms.

INTELLECTUAL PROPERTY

All intellectual property rights, including copyright, in the App and its contents, are owned by or licensed to Nardagani, Inc. You may not copy, reproduce, or distribute any part of the App without prior written consent.

TERMINATION OF USE

We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in inappropriate behavior. You may also terminate your subscription at any time through your account settings or by contacting us directly.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Nardagani, Inc., its directors, officers, employees, contractors, agents, suppliers, licensors, successors, and assigns from and against any and all losses, claims, causes of action, obligations, liabilities, and damages whatsoever, including attorneys' fees, arising out of or relating to your use of the App, any breach of these Terms, or any claim that your use of the App infringes the rights of a third party.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, in no event will Nardagani, Inc. be liable to you or any third party for any indirect, incidental, special, punitive, or consequential damages arising from your use or inability to use the App, or any issues related to the App's performance. This includes, without limitation, loss of data, loss of profits, business disruptions, errors, inaccuracies, or damages resulting from the use or non-use of the App, even if Nardagani, Inc. has been advised of the possibility of such damages.

In no event shall Nardagani, Inc.'s total liability to you, or any third party making a claim through you, exceed the amount paid by you for the App in the 12 months preceding the event that gave rise to the claim. This limitation of liability applies collectively to all claims, and the existence of multiple claims will not increase this limit.

You acknowledge and agree that the limitations of liability provided herein are a fundamental part of the agreement between you and Nardagani, Inc. and that our pricing and Terms have been established with these limitations in mind.

NO REPRESENTATIONS OR WARRANTIES

The App, including all content and features provided through the App, is made available to you on an “as-is” and “as-available” basis. Nardagani, Inc. and its suppliers make no representations or warranties of any kind, whether express or implied, regarding the App, its content, or any related services, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the App will operate uninterrupted, be error-free, or be free from defects or viruses. Additionally, we do not guarantee the accuracy, reliability, or completeness of any content, materials, or information available through the App, nor do we warrant that the App will meet your expectations.

Access to the App may be unavailable due to factors including, but not limited to, high demand, system upgrades, technical issues, or scheduled/unplanned maintenance.

Some jurisdictions may not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Idaho. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in the State of Idaho, and not through a court trial.

MODIFICATIONS TO THE TERMS

We may update or modify these Terms at any time. All changes will be posted on this page, and the updated version will be effective as soon as it is made available.

APPLE AND GOOGLE PLAY APP STORE TERMS

The following terms apply to the use of the App on Apple and Google Play platforms:

The license granted to you for our mobile application is limited to a non-transferable license to use the App on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service.
We are responsible for providing maintenance and support services with respect to the mobile application as specified in these Terms, and the App Distributor (Apple or Google) has no obligation to provide such services.

You may be entitled to a refund through the App Distributor if the App fails to conform to applicable warranties, but Nardagani, Inc. has no further warranty obligation.
